Vaping Regulations and Laws in New Zealand: 2025 Update

Ministry of Health – Regulatory Changes to Vaping Laws

To better protect children and young people, the New Zealand Government has introduced significant amendments to the Smokefree Environments and Regulated Products Act 1990. These new regulations affect both general retailers and specialist vape retailers and focus on restricting product visibility, advertising, and the sale of disposable vape devices.

Effective From 17 June 2025:

1. Ban on Disposable Vapes

  • All vaping devices that cannot be refilled or recharged will be prohibited.

  • Only rechargeable and refillable pod systems will be permitted for sale.

2. Display Restrictions (In-store and Online)

  • General Retailers must ensure that vaping devices, products, and packaging are not visible to customers. These products must be kept in a non-visible location, such as under the counter or inside a closed cabinet.

  • Specialist Vape Retailers (SVRs) are allowed to display products in-store but must ensure that none of the items are visible from outside. Many SVRs may modify their store layouts or use window films to comply.

  • Online retailers must remove all vape product imagery. No product photos or visual representations will be allowed on websites.

3. Advertising and Promotional Restrictions

  • No promotional messages, even to existing customers, are permitted.

  • All forms of advertising—including in-store posters, product imagery online, and promotional campaigns—are prohibited.

  • Free giveaways, discounted prices, gifts, loyalty rewards, and contests related to vape products are now banned.

4. Child Safety Features

  • All vape devices must incorporate non-removable child safety mechanisms that cannot be overridden or disabled.

All of our disposable vapes meet the new legal definitions and requirements and will remain available for sale beyond the compliance deadline.
